JUSTICE SHIVAJI PANDEY ORAL ORDER 16-07-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Kasim Bazar P.S.Case No. 156 of 2013 registered u/s 302/34 IPC. As per the FIR in the mid night while the son of informant was sleeping in his house along with Kishore Kumar, Sudhakar Sahni, Uttam Sahni (petitioner), Sulendra Sahni and Ravindra Mahto dragged him from the house and started assaulting and later on when he became serious they fled away. Thereafter the victim was brought to Munger Hospital for treatment where he was declared dead.

The name of petitioner has come in the FIR. It is not a fit case for grant of anticipatory bail. This petition is dismissed. However, liberty is given, if so advised, petitioner may surrender before the court below within 3 weeks and if he so surrenders, the court below will pass order on merit available on the record.
