JUSTICE BIRENDRA KUMAR ORAL ORDER 30-01-2017 Heard the learned counsel for the petitioner, the informant and the State.

This is a petition for grant of regular bail for offence under Sections 498A, 341, 323 and 34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act. Subsequently, Section 304B of the Indian Penal Code has been added. In the first information report there is allegation of torture including physical assault against the husband of the informant-deceased. The petitioner is father-in-law of the informant-deceased.

Submission of the petitioner is that the allegation is general and omni bus against the petitioner and he is in custody since 03.08.2016.

The learned counsel for the informant opposed the prayer on the ground that in paragraph 11 of the case diary there is re-statement of the informant wherein she has levelled specific allegation against the petitioner.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.43636 of 2016 (4) dt.30-01-2017 2/2 Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Buxar (M) P.S. Case No. 23 of 2016 to the satisfaction of the Chief Judicial Magistrate, Buxar, or successor Court.
