JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2017 The petitioner seeks regular bail in connection with Ramgarhwa P.S. Case No. 39 of 2016, registered for offences punishable under Sections 489(B) and 489(C) of Indian Penal Code.
Allegation against the petitioner is of recovery of huge amount of fake currency note.
It has been submitted on behalf of the petitioner that petitioner is a Government teacher and he has only taken lift in the vehicle, from which the alleged recovery has been made and has nothing to do with the said recovery. Further he has no criminal antecedent and has been in judicial custody since 08.06.2016. Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and

No.27309 of 2017 (2) dt.12-07-2017 2/2 circumstances of the case and also the fact that in this case huge quantity of fake currency note has been recovered, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, since the petitioner has been in custody for about one year, the trial court is directed to expedite the trial and try to conclude it within a period of nine months. At the same time, S.P. Motihari, is directed to ensure the production of witnesses in the Trial Court on the date fixed so that the trial can be concluded within the prescribed period. (Vinod Kumar Sinha, J) sunil/- U T
