ANJANA MISHRA ORAL ORDER 12-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the complainant (O.P. No.2) as well as the learned counsel for the State. The petitioner is apprehending his arrest in connection with Tr. No.2394 of 2013 arising out of Complaint Case No.320-C of 2012 for allegedly having committed the offence under Section 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that general and omnibus allegation has been made against several persons, including the petitioner, that they have collected

It is submitted that the Company, namely, Long Life Concept Marketing Private Ltd., had accepted deposits from several persons through their Agents between July, 2009 and November, 2010. However, when the same was not returned, the present complaint was lodged.

Learned counsel for the complainant submits that the present petitioner is one of those persons, who had been responsible for luring the depositors to make deposits in favour of the aforesaid Company. However, he is unable to inform this Court as to on what basis the petitioner's name had come and from whom. He has also failed to bring on record any further material so as to rope the present petitioner. Considering the aforementioned facts and circumstances and also in view of the fact that the petitioner had earlier been extended the benefit of interim protection and is willing to co-operate in whatever investigation and shall appear in the court below on all dates and shall not abstain himself on two consecutive dates without there being any reasonable cause and without the liberty of the court, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the

No.2394 of 2013 arising out of Complaint Case No.320-C of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
