JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 08-08-2016 From the pleadings on record, it appears that the entire retrial dues as admissible to the petitioner, according to the respondents, has been paid.

Learned counsel for the petitioner has raised a dispute over amount of gratuity paid to the petitioner. He contends that in terms of Government resolution, Rs. 10 lacs has been fixed as the maximum amount payable as gratuity to the employees of the State Government, after retirement whereas the petitioner has been paid a sum of Rs. 7,05,540/-only. There is no pleading on record as to how the

Patna High Court CWJC No.7023 of 2014 dt.08-08-2016 2/2 petitioner is entitled for maximum amount of gratuity as fixed by the State Government. She has been found to be entitled to a sum of Rs. 7,05,540/- against DCRG amount by the office of the Accountant General.

I do not find any reason to interfere in the matter at this stage. However, the petitioner will be at liberty to approach the Civil Surgeon-cum-Medical Officer, Patna to satisfy that she is entitled for the maximum amount of gratuity, as fixed by the State Government, This application stands disposed of.
