1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 120(B) of the Indian Penal Code as well as Section 27 of the Arms Act.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner had earlier moved this Court seeking regular bail by filing Cr. Misc. No. 52061 of 2024 and the same came to be rejected by an order dated 05.10.2024. It is further submitted that petitioner is in custody since 22.12.2023. It is next submitted that the instant bail application has been filed seeking regular bail on the ground that co-accused, namely, Niraj Kumar Sah has been granted the privilege of regular bail by an order dated 02.05.2025 in Cr. Misc. No. 15411 of 2025 passed by a learned Coordinate Bench of this
Patna High Court CR. MISC. No.39004 of 2025(2) dt.20-06-2025 2/2 Court.

Learned counsel appearing on behalf of the informant vehemently opposes the bail application of the petitioner and submits that while rejecting the bail application of this petitioner by an order dated 05.10.2024 in Cr. Misc. No. 52061 of 2024, this Court had recorded the order in detail and what persuaded the Court not to grant bail to the petitioner in a case of triple murder was that the wife of the deceased had specifically named this petitioner. It is further submitted that co-accused, namely, Niraj Kumar Sah, who has been granted the privilege of regular bail by a learned Coordinate Bench of this Court, was not named by the wife of the deceased. It is next submitted that trial has commenced and four witnesses have been examined.
5. Considering the submissions made by the learned counsel appearing on behalf of the informant, the Court is not inclined to release the petitioner on the bail in connection with S.T. No. 352 of 2024 arising out of Madhepura (Bharrahi O.P.) P.S. Case No. 1234 of 2023 pending in the Court of learned Additional Sessions Judge-II, Madhepura/Successor Court.
6. Hence, prayer for bail of the petitioner is rejected. (Satyavrat Verma, J) Kundan/- U T
