JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 120B of the of the Indian Penal Code.
The prosecution case is that niece of the informant was killed by her husband and step-mother Jhinku Devi. The name of the petitioner sprang up during investigation when the father of the victim in his confession named the petitioner. It is further submitted that petitioner is neither family member of the victim nor in any way related with the husband of the victim. During investigation, it transpired that the husband of the victim took the victim of her step-mother, namely, Jhinku Devi's house then during course of getting the pregnancy terminated she died. Considering the same, father of the husband of the victim
Patna High Court Cr.Misc. No.33470 of 2015 (2) dt.13-08-2015 2/2 Shikandar Yadav has been granted anticipatory bail vide Criminal Miscellaneous No.20350 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour (Gouradih) P.S. Case No.121 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
