JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 380, 302/34 of the Indian Penal Code.

The present occurrence is said to have taken place in the year 2003 and the F.I.R. was lodged against unknown but in course of investigation, some witnesses stated that petitioner being servant of the informant committed the murder of the deceased. Petitioner could be arrested after thirteen years of the alleged occurrence but in course of trial, the informant failed to identify the petitioner which is evident from perusal of Annexure-3 to the petition.

No.42568 of 2016 (3) dt.28-11-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Lakhisarai in connection with Sessions Trial No. 192 of 2016 arising out of Lakhisarai P.S. Case No. 311 of 2003.
