Petitioner is languishing in custody in connection with Mahila P.S. Case No. 44 of 2016 for the offences punishable under Sections 376/313/504/34 of the Indian Penal Code and Section 3⁄4 of the D.P.Act.

According to F.I.R. co-accused Md. Haidar, who is son of this petitioner, was in physical relation with informant on the pretext of marriage. When the informant was pregnant Md. Haidar refused to marry her.

Submission is that the parties had entered into an agreement as Md. Haidar has agreed to marry with the informant. Considering the aforesaid facts, let petitioner,

Patna High Court Cr.Misc. No.52454 of 2016 (2) dt.08-12-2016 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Gaya/Successor Court, in connection with Mahila P.S. Case No.44 of 2016.
