Earlier prayer for bail of the petitioner was rejected by this court vide order dated 29.9.2016 giving liberty to the petitioner to renew his prayer for bail, if his trial is not concluded within five months. However, impugned order passed by the Addl. Sessions Judge reflects that trial of the petitioner is still pending. Moreover, having more or less similar allegation, co-accused Dinesh Yadav @ Dinesh Kumar Yadav has already been granted privilege of bail by this court vide order dated 12.4.2017 passed in Cr. Misc. no. 12014/2017.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II-cumSpecial Judge, Katihar in Pranpur (Rosana) P.S. Case no. 74/2016. shahid (Hemant Kumar Srivastava,J) U T
