The petitioner seeks bail in Khudwan P.S. Case No. 12 of 2013, instituted for the offence under Section(s) 147, 149, 341, 427, 435, 384 of Indian Penal Code, Section 27 of the Arms Act and Section 17 of CLA Act.

Counsel for the petitioner submits that First Information Report is against unknown. There is no specific allegation levelled against the petitioner. He has not been put on Test Identification Parade. The name of petitioner has come on the basis of confessional statement of co-accused Bali Ram Yadav, Sridhar Pathak and Bira Das @ Bira Ravi Das who have already been granted bail by coordinate Benches of this Court

Patna High Court CR. MISC. No.40675 of 2019(3) dt.30-07-2019 2/2 vide orders dated 3.6.2014, 19.11.2014 and 22.9.2014 passed in Cr. Misc. 17954 of 2014, 41644 of 2014 and 17304 of 2014 respectively.

Petitioner is in custody since 27.7.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Khudwan P.S.
