The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 420, 498A and 494 of the Indian Penal Code.

The basic accusation is of torture and performing second marriage.

The petitioner and the informant are present in the court.

It is jointly submitted that the petitioner and the informant both have performed second marriage.

No.42177 of 2014 (5) dt.13-10-2015 2/2 A supplementary affidavit jointly sworn by the petitioner and the informant has been filed stipulating therein that since the factum of marriage between the parties is disputed, hence, they decided to settle the dispute on payment of Rs.Six lakhs. Two lakhs rupees in cash and Rs.Four lakhs through Draft No. 544816 drawn on S.B.I. Jehanabad Branch are being handed over to the counsel for the informant for handing it over to the informant. It is expected from the learned counsel for the informant to make necessary endorsement to that effect on the record.

Considering the present stand of the parties, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 100 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
