2. The petitioner has preferred this application for grant of regular bail in connection with Khazanch Hat Sahayak P.S. Case No. 644 of 2020 dated 25.11.2020 registered for the offences punishable u/ss 401, 413 and 414 of the Indian Penal Code.
3. As per the prosecution case, on 24.11.2020, the informant and the other police personnel including the lady constables reached at Kundi Bridge and apprehended some of miscreants including ladies in suspicious condition having some money and tools to be used for commission of theft. One of the lady miscreants, namely Aarti Devi disclosed that she and the
Patna High Court CR. MISC. No.39140 of 2025(2) dt.07-07-2025 2/3 apprehended persons and the others operate an organized gang indulged in committing theft and they had recently committed theft. The main members of the gang are her brother Bipin Yadav, Sahel Khan @ Bhutto, Seema Khatun @ Simiya (petitioner) and as per instruction, they had assembled there to distribute the money among themselves. Accordingly, the informant seized the tools intended for use in the commission of theft and recovered Rs. 2,52,000/-. The accused persons were apprehended on the spot.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has eleven criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 04.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond
Patna High Court CR. MISC. No.39140 of 2025(2) dt.07-07-2025 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with K.Hat (Sahayak) P.S. Case No. 644 of 2020 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
