The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code. It is alleged that petitioner no. 1 Jigyashu Kumar by getting forged ATM card prepared in the name of the informant withdrew Rs.5,00,000/- from the account of the informant and her son. It is alleged that petitioner no. 2 being the father of petitioner no. 1 subsequently made an agreement to return the withdrawn amount in installment.
Patna High Court Cr.Misc. No.33995 of 2015 (2) dt.31-08-2015 2/2 It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled.
Considering the thrust of accusation against petitioner no. 1 Jigyashu Kumar, let the learned court below consider the prayer for regular bail of petitioner no. 1, if he surrenders before the learned court below within a period of six weeks.
Since petitioner no. 2 has been roped in the present case being the father of main accused, let the above named petitioner no. 2 be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur P.S. Case No. 207 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
