With regard to death of Bittu Kumar, an employee of Sagarmal and Sons, a U. D. Case was registered and during course of investigating upon, statement of other employees were recorded as well as C. C. TV. Footage were also seen wherefrom it is apparent that there was scuffle in between deceased with petitioner during course of which, deceased was assaulted by the petitioner with fists and slaps and further, was pushed on account of which, he fell down on the floor and became unconscious. Deceased was immediately taken to hospital where he died and so, instant case has been registered on the self-statement of the I.O. of the aforesaid U.D. Case.

No.52047 of 2016 (03) dt.19-12-2016 From perusal of the case diary, it is evident that occurrence took place on account of some sort of altercation in a spur of moment and that happens to be reason behind submission of chargesheet under Section 304 of the I.P.C. In the aforesaid background, considering the nature of allegation in consonance with the period of detention since 14.05.2016, petitioner, Rajesh Kumar Rajak is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.
