The Petitioner seeks bail in Bhagwan Bazar P.S. Case No.284 of 2016 instituted for the offence under Section(s) 30 of the Bihar Excise Act.
It is alleged that the Informant received information that one Kari Rai has indulged in sale and purchase of country made liquor. When the police went for verification of the said information, one person tried to run away but was apprehended, who disclosed his name as Dharmnath Ram (petitioner). The apprehended person told that he has been employed by Kari Rai on the daily wages of rupees five hundred for selling the liquor. Seizure list has been annexed with the written report,
Patna High Court Cr.Misc. No.2231 of 2017 (2) dt.02-02-2017 2/2 which does not show that any recovery has been made from the conscious possession of the petitioner. It is mentioned that recovery has been made from thatched house situated in MohallaNabiganj Koiri Tola. The petitioner is said to be in custody since 05.10.2016 having clean antecedents.
In view of such, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, in connection with Bhagwan Bazar P.S. Case No.284 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
