Petitioner is apprehending his arrest in connection with Bihiya P.S. Case No.201of 2018 for the offences registered under Sections 341, 323, 379, 504 and 506/34 of the Indian Penal Code.

Informant has stated in his written complaint that on 25.05.2018 at about 10:45 P.M. when he along with his brother were coming from his native village Tipur on motorcycle then three miscreants on one motorcycle overtook and stopped them and started abusing and assaulting them and asked to leave motorcycle and run away, in the meantime, informant identified one of the miscreants as Bijali Yadav (petitioner). It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.45009 of 2018(4) dt.04-09-2018 2/2 he is innocent and committed no offence and he has been falsely implicated in this case. Nothing has been recovered from the possession of petitioner or his house.

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Ara in connection with Bihiya P.S. Case No. 201 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (S. Kumar, J) Rajiv/manoj U T
