JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323,341,504,354B and 379/34 of the Indian Penal Code.

The prosecution case is that the when the informant reported the matter for getting the mutation done by accused with regard to the land of the informant then the petitioner tore the blouse of the informant, made assault and took away five hundred rupees.

It is submitted by the learned counsel for the petitioner that in the background of civil nature of dispute with regard to the issue of mutation of land the present case has been lodged. The FIR was registered on 11.5.2015 but it reached to the court of

Patna High Court Cr.Misc. No.34883 of 2015 (2) dt.02-09-2015 2/2 CJM on 14.5.2015 which suggests that the FIR was registered by antedating. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Industrial P.S. Case No.46 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
