13-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The sole petitioner is seeking Regular Bail in connection with G.R.P. Patna P.S. Case No. 74/2017 for the offences under Sections 273 IPC and 30(a) of the Bihar Excise Act, 2016.

The petitioner is said to be in custody since 18.02.2017.

Learned counsel for the petitioner submits that there is an allegation of seizure of 370 pieces pouch each containing 200 ML of spicy liquor made in Jharkhand. He submits that seizure is not in accordance with the provisions under Section 100 Cr.P.C. and that the petitioner is in custody for four months approximately.

Patna High Court Cr.Misc. No.25618 of 2017 (2) dt.13-06-2017 Learned Additional Public Prosecutor opposed the prayer for bail of the petitioner.

However, considering the nature of allegation and that the petitioner is in custody for approximately four months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Patna, in connection with G.R.P. Patna P.S. Case No. 74/2017.
