The petitioners are not named in the FIR of Lalganj P.S.Case No.110 of 2014 under Sections 302 and 201/34 IPC on finding of the dead body of the lady by the road side, the Chaukidar of no.2/12 reported to the police about the killing and disposal of the dead body of the lady. The FIR was lodged against unknown and for quite sometime, there was no clue as to what had really happened, However, subsequently, witnesses came forward as belatedly as on 04.06.2014 to point out that the death of the lady had been caused by the petitioners and others in connection with demand of Rs.2,00000/- for running a business. Submission is that there was no report in spite of the story having come from the witnesses. Submission also was

No.16785 of 2015 (3) dt.16-07-2015 that the witnesses who came forward were weaving out a story belatedly and there was no reason for the petitioners to have any concern with the husband of the lady because the two had solemnized marriage out of love and affection for each other. Regard being had to the submission and the materials on record, let the above named two petitioners be directed to be released on bail either in the event of their arrest by the police or surrender in the court below on execution of a bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of CJM, Vaishali at Hajipur in the above noted case, subject to the condition as laid down under Section 438(2) Cr.P.C.
