The petitioner is apprehending arrest in a case registered for the offences punishable under Section 273/34 of the Indian Penal Code and 47(a) of the Excise Act. 291.8 litre of country made liquor was recovered from the shop, situated in the house of Pawan Bhagat, alleged to have been taken on rent by the petitioner.
It is submitted by learned counsel for the petitioner that neither the petitioner was present at the time of seizure nor there is anything on record to suggest that the shop, in question, was taken on rent by this petitioner.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Patna High Court Cr.Misc. No.35347 of 2015 (2) dt.07-09-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Salkhua P.S. Case No.22 of 2015, pending before the learned Chief Judicial Magistrate, Saharsa.
With the above observation, this application is, accordingly, disposed off.
