Petitioner seeks bail in Mofassil P.S.Case No.200 of 2018 registered for the offences under Sections 400, 401, 414 of the I.P.C.

Allegation against the petitioner is that while he was traveling on Eco Sports car police intercepted the same and recovered Rs.1,8,500/- and some incriminating articles and apprehension that they were going to commit dacoity/theft. Submission of the learned counsel for the petitioner is that similarly situated co-accused Naresh Kumar has already been granted bail by co-ordinate Bench of this Court vide order dated 10.08.2018 passed in Cr.Misc.No.47202 of 2018 and the petitioner is in custody since 15.6.2018 having no criminal antecedent.

Patna High Court Cr.Misc. No.46956 of 2018 (3) dt.19-09-2018 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, the trial court is directed to verify the antecedent of the petitioner and, if there is no any antecedent against the petitioner, he will release him on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to his own satisfaction .
