The petitioner has filed the instant application for grant of regular bail in connection with Ghorasahan P.S. Case No. 233 of 2020 registered under sections 399, 402 and 414 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per allegation in the FIR, the petitioner along with others was arrested and on search a country made pistol and live cartridge were recovered from possession of the petitioner. It is stated that the petitioner was making preparation for committing bank dacoity. It is submitted that no incriminating article has been recovered and the petitioner has been falsely implicated

Patna High Court CR. MISC. No.37530 of 2020(2) dt.05-02-2021 2/2 only for the reason that he has some criminal antecedent, in which he is on bail. He is in custody since 20.6.2020. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case and the petitioner being in custody since 20.6.2020, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Ghorasahan P.S. Case no. 233 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikarahana at Dhaka, East Champaran.
