JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners seek bail in connection with Ara Mufassil P.S. Case No. 195 of 2016 registered under Sections341, 323, 308, 504, 379/34 of the Indian Penal Code. The allegation against the petitioners is of assaulting the informant with Lathi-danda.

Learned counsel for the petitioners submits that no injury has been found on the person of the informant. Petitioners have been falsely implicated in the case. Main accused of the case namely, Inderdeo Ram, has been granted bail by this Court vide order dated 21.12.2016 passed in Cr. Misc. No. 54523 of 2016.

No.53972 of 2016 (3) dt.14-02-2017 2/2 Considering the facts and circumstances of the case, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Muffasil P.S. Case No. 195 of 2016 subject to the conditions that one of the bailors must be a close relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
