JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.

It is alleged that the petitioner assaulted the informant with brick on his head.

It is submitted by learned counsel for the petitioner that no injury was caused to the informant. A statement has been made in Para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid stand of the parties, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.34436 of 2015 (2) dt.17-08-2015 before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for three months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa (Balia Belon) P.S. Case No. 29 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The provisional bail will be confirmed by the learned Court below only on verification of the fact that the informant has sustained no injury. But in case it is found that the informant has sustained injury, the petitioner will surrender and pray for regular bail.
