Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Barh P.S. Case No. 547 of 2019 for the offence punishable under Sections 341, 3423, 307, 506/34 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was also added. The deceased is the informant of the case. The date of occurrence is 11.11.2019 and thereafter the deceased got himself treated in P.M.C.H. and came back and he died on 17.11.2019. As per the F.I.R. one Karu Yadav is said to have assaulted the deceased and there are general and omnibus
Patna High Court CR. MISC. No.50862 of 2021(2) dt.15-02-2022 2/2 allegations against this petitioner. For the purposes of bail, in the opinion of this Court, Section 302 of the Indian Penal Code may not be made out against this petitioner.
Considering the aforesaid facts, this bail application is allowed.
Accordingly, let the petitioner, above named, in the event of his arrest/surrender within ten weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, DistrictPatna, in connection with Barh P.S. Case No. 547 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
