JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, 432 bottles (180 ml. each) and 360 bottles (375 ml. each) of foreign liquor were recovered from a Bolero vehicle. There is no recovery from the conscious possession of the petitioner. The name of the petitioner has cropped up on the basis of confessional statement of coaccused, Md. Asgar. Petitioner claims his antecedent to be clean and he is in custody since 29.05.2017.

Considering the facts and circumstances of the case,

No.32343 of 2017 (2) dt.13-07-2017 2/2 the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj P.S. Case No.129/2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
