JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 34 and 201 of the Indian Penal Code. Allegation is that someone had killed husband of informant due to some land dispute.

It has been submitted on behalf of petitioner that he is in custody since 14.7.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. He has falsely been implicated in the present case. He has been made accused merely on the basis of suspicion. There is no other substantive evidence to suggest implication of petitioner in the present case. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.51259 of 2016 (2) dt.05-12-2016 2/2 amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-3, Gaya , in connection with Belaganj P.S. Case no. 184 of 2016.
