This application has been filed in connection with G.R.P. Darbhanga (Sitamarhi) P.S.Case No.92 of 2016 for the offence under Sections 370 of the Indian Penal Code and Section 16 of the Bounded Labour System Abolition Act.

Heard learned A.P.P. also.

It is submitted on behalf of the petitioner that the allegation against the petitioner is that he along with other persons was taking eight minor boys to Bombay and except that there is nothing against the petitioner. It is also his case that the Petitioner is a 19 years old and he has been falsely implicated in this case as he was also going by the same Train and he is in

Patna High Court Cr.Misc. No.55022 of 2016 (3) dt.28-01-2017 custody for about three months and he has no clean antecedent. Having heard both sides. In view of the fact that the petitioner is in custody for about three months and he is 19 years old as well as it is not only the petitioner was caught but also other persons were caught, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. (Railway), Samastipur in connection with G.R.P. Darbhanga (Sitamarhi) P.S.Case No.92 of 2016, with following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part two appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
