2. The petitioner is in custody since 14.04.2017 in connection with Motihari Town P.S. Case No. 74 of 2017 for the offences alleged under Sections 457 and 380 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated and in fact no recovery of the stolen goods from the possession of the petitioner has been made as alleged. The articles having not been put on Test Identification Parade to identify the same have been stolen goods in question. The petitioner claims clean antecedents.
4. Having regard to the nature of accusations, gravity
Patna High Court Cr.Misc. No.31912 of 2017 (2) dt.13-07-2017 2/2 of the offence alleged as well as recovery of the stolen articles said to have been made from the possession of the petitioner, this Court is not inclined to grant the privilege of bail to the petitioner.
