Petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 324, 353, 337, 338, 332, 333 and 504 of the Indian Penal Code, Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Section 27 of the Arms Act.
5 litres of country made liquor is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern
Patna High Court Cr.Misc. No.45039 of 2018 (3) dt.18-08-2018 2/2 with the seized liquor. He has been falsely implicated in the case at the instance of his enemies by planting aforesaid recovery from his possession. He has no criminal antecedent. He has been languishing in custody since 31.10.2017. Similarly situated coaccused, namely, Rohit Manjhi and Laxman Ravidas have been enlarged on bail by this court vide order dated 13.02.2018 and 23.01.2018 passed in Cr. Misc. No. 7839 of 2018 and 2283 of 2018 respectively while Lalu Kumar @ Lallu Kumar and Loulesh @ Laulesh Manjhi have been enlarged on bail by a co-ordinate bench of this Court vide order dated 30.01.2018 passed in Cr. Misc. No. 5128 of 2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Pipra P.S. Case No. 71 of 2017, Special Case No. 7565 of 2017.
