The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 465, 467, 468, 34 of the Indian Penal Code. The prosecution case is that the complainant was a Power of Attorney holder with regard to 27 kathas of land of his sons but co-accused Nawal Kishore Rai executed an agreement for sale with regard to land in question by forging the signature of the complainant. The petitioners being the sons-in-law of Nawal Kishore Rai are witnesses to the agreement for sale. It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.32829 of 2015 (2) dt.11-08-2015 2/2 that the thrust of accusation against Nawal Kishore Rai and coaccused Kusum Devi, mother of co-accused Nawal Kishore Rai, who has been granted anticipatory bail by a co-ordinate bench of this court vide Criminal Miscellaneous No.19393 of 2015. Moreover, statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. It is submitted by learned counsel for the informant that the petitioners are also parties to the forgery. Considering the thrust of accusation against Nawal Kishore Rai, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Complaint Case No.2375 C of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
