The petitioner seeks bail in a case instituted under Sections 420, 467, 468 and 471 of the Indian Penal Code. The prosecution story in brief, is that the informant received threat call on his mobile phone bearing no. 9534624451 and 9939810511 from mobile no. 8969641617 that he will be eliminated if he did not withdraw the case. It is also alleged that the SIM stands in the name of Krishan Kumar Bhotia and it is purchased from the shop of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.09.2016. The charge sheet has been submitted in the present case. The petitioner has got no
Patna High Court Cr.Misc. No.51425 of 2016 (2) dt.06-12-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The SIM of the mobile, which was used by the accused persons is said to have been purchased from the shop of the petitioner. Except for this, there is no other substantive evidence to suggest his implication in the present case.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheikhpura, in connection with Barbigha P.S.
