2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 140 (3), 103(1), 238 and 61 of the BNS.

3. The case of the prosecution is that on 20.08.2025, the husband of the informant told her that he was going to meet Manawati Devi of Village- Semra for some work. When he did not return home till night, the informant made a call on his mobile number but the phone was switched off. Thereafter, when she enquired from Manawati Devi, she was told that her husband had not come to her house. Subsequently, the dead body of the husband of the informant was recovered.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is contended that in the FIR itself, it has been alleged that the deceased has gone to the house of Manawati Devi but from perusal of paragraph-66 of the case diary, it is clear that there was only telephonic conversation between the deceased and Manawati Devi on 28.01.2025 and except for this, nothing incriminating has been collected during investigation. So far as petitioner no. 2 is concerned, his name has surfaced on the basis of the confessional statement. There is nothing except the confessional statement against the petitioner no. 2. Moreover, the petitioners are languishing in judicial custody since 03.02.2025 having no criminal antecedent. 5.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail. It is submitted that except the CDR and the confessional statement, there is no other material available against the petitioners.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Mairwa P.S. Case No. 47 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with
