2. The petitioner seeks bail in Sour Bazar P.S. case No. 11 of 2024 instituted for the offences under Sections 392, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. Prosecution allegation, in short, is that while the informant was on the way, the accused persons, variously armed, pushed his motorcycle and took Rs. 11,000/-, PAN card and other documents. On protest, the accused persons fired and trying to flee away but one of them was apprehended. The petitioner was not arrested on spot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The name of the petitioner has transpired on the basis of confessional statement of co-accused, namely, Raj Kumar. No incriminating material has been recovered from the conscious possession of the petitioner. Charge-sheet has been submitted in this case and cognizance has also been taken under Sections 392, 411, 413, 414 of I.P.C. and Section 27 of the Arms Act. The petitioner is in custody since 12.01.2024 and has four criminal antecedents in which he is on bail in all cases.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP submits that the petitioner has criminal antecedents and he does not deserve to be released on bail.
6. Considering the aforesaid facts and circumstances of the case, the period of custody undergone by the petitioner and the fact that the cognizance has been taken in this case, this Court is inclined to grant bail to the petitioner.
