1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(2) 118(1), 109, 352, 351(2), 351(3) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner started abusing him on the pretext that he was going to contest an election, on objection, petitioner assaulted him by knife causing injury on thigh, thereafter Bipin, Sunil, Sanjeev and Sandeep along with 3-4 unknown accused assaulted and Sandeep assaulted by farsa causing injury over the

Patna High Court CR. MISC. No.40520 of 2026(2) dt.02-07-2026 2/3 other thigh and Bipin pressed his private parts so hard that froth started coming out of the mouth and accused fled when people gathered.

Learned counsel for the petitioner submits petitioner has been falsely implicated in the instant case by the informant, it is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to election, the occurrence is alleged to have taken place, it is next submitted no doubt petitioner is alleged to have stabbed the informant causing injury on thigh, but then the injury has been opined to be simple in nature, it is also submitted that from side of the petitioner Madhuban P.S. Case No. 465 of 2025 has been instituted against the informant and wherein petitioner has alleged that he was stabbed by the informant.

Learned A.P.P. for the State opposes the anticipatory bail application and submits that no doubt the injury suffered by the injured has been opined to be simple in nature as recorded in the order impugned, but then there is a specific allegation against the petitioner of assaulting the informant by knife causing injury on thigh, it is next submitted knife is a dangerous weapon as both sides are sharp, it is also

No.40520 of 2026(2) dt.02-07-2026 3/3 submitted merely because petitioner has also instituted an FIR alleging that he was stabbed by the informant that in itself does not entitle the petitioner to be released on bail, it is further submitted that the case of the instant informant in the case filed by the petitioner will be dealt on merit when it comes before the Court.

6. After hearing, learned counsel for the parties this Court is in agreement with the submission made by the learned A.P.P. for the State, as such, is not inclined to extend the privilege of anticipatory bail to the petitioner.

7. Accordingly, the instant anticipatory bail application stands rejected.
