ANJANA MISHRA ORAL ORDER 15-09-2015 A supplementary affidavit has been filed on behalf of the petitioner today in Court. Let it be kept on the record. Heard learned counsel for the petitioner and the learned counsel for the Bihar State Food Corporation as well as the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Obra P.S. Case No.40 of 2015 for allegedly having committed the offences under Sections 409 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has already paid Rs.22,00,000/- of the alleged
Patna High Court Cr.Misc. No.33685 of 2015 (3) dt.15-09-2015 2/2 defalcated amount.
Learned counsel for the BSFC submits that if such deposits have already been made, the petitioner may be extended the privilege of anticipatory bail as has been done in several other similarly situated persons. However, he submits that the aforesaid amount shall be subject to verification made by the BSFC.
In view of such submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, District-Aurangabad, in connection with Obra P.S. Case No.40 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
