JUSTICE SHIVAJI PANDEY ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner and learned counsel for the State as well as the informant. The petitioner seeks bail in Raghunathpur P.S. Case instituted for the offences under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
Allegation has been made that all the three persons came and killed the victim.
Learned counsel for the petitioner submits that earlier the son of the deceased (informant) had kidnapped the daughter of the Dhananjay Singh and from the remand home he had also taken away the girl. The informant is facing two criminal cases.
Patna High Court Cr.Misc. No.39482 of 2016 (3) dt.19-09-2016 During argument it has been stated that there is no allegation against the victim nor he had committed the crime. Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the trial court is directed to expedite the trial.
