JUSTICE SUDHIR SINGH ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 406, 420, 120B and 34 of the Indian Penal Code. Allegation is that marriage of informant's daughter was fixed on payment of Rs. 3 lacs between informant and bridegroom party. An amount of Rs.2 lacs and one thousand was given to Yogi Paswan, father of petitioner, to hand it over to the bridegroom party but, according to bridegroom party, nothing was handed over. As such, informant was cheated by hatching a conspiracy.

It has been submitted on behalf of the petitioner that he is in custody since 29.7.2016. Petitioner has got no criminal antecedent. Petitioner has falsely been implicated due to village politics. Allegations made in the F.I.R. are denied. Other coaccused have been granted anticipatory bail by the court below. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.42361 of 2016 (2) dt.03-10-2016 2/2 amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Barh, Patna, in connection with Barh P.S. Case no. 137 of 2016.
