Petitioners apprehend arrest in a case registered for the offence punishable under Sections 366/34 of Indian Penal Code.

As per prosecution case, these petitioners along with other FIR named accused persons committed sexual misconduct with the grand daughter of the informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. It is submitted that specific accusation of sexual misconduct is against co-accused Ajit Kumar. These petitioners have made accused in this case merely because they are brothers

Patna High Court CR. MISC. No.41823 of 2022(2) dt.29-11-2022 2/2 of Ajit Kumar. Further, victim in her statement, recorded under Section 164 of Cr.P.C., has not alleged any commission of sexual misconduct against these petitioners. Similarly situated co-accused, Manjit Kumar Ram, has already been enlarged on anticipatory bail by co-ordinate Bench of this Court vide order dated 15.06.2022 passed in Cr. Misc. No. 14923 of 2022. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Sarai P. S. Case No. 246 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
