Petitioner seeks bail in Sour Bazar P.S.Case No.198 of 2017 registered for the offences under Sections 147, 148, 149, 341, 323, 307, 448, 380, 504, 506 of the I.P.C. Allegation as per the F.I.R. against the petitioner is that he fired on Bhushan Kumar causing injury in his abdomen. Submission of the learned counsel for the petitioner is that injured Bhushan Kumar in his statement recorded in paragraph 41 of the case diary stated that shot was fired by Arun Kumar which hit the right finger of the mother of the informant and thereafter hit him also. Further submission is that the petitioner is in custody since 26.04.2018 having no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Saharsa, in Sour Bazar P.S. Case No.198 of 2017 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trail and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
