JUSTICE RAKESH KUMAR ORAL ORDER 24-10-2016 Heard Sri Nityanand Kumar, learned counsel for the petitioner and Sri Jagdhar Prasad, learned Additional Public Prosecutor.

The sole petitioner who is in custody only since 3.5.2016 in Khusrupur P.S. Case No. 70 of 2016 registered for the offence under Section 302/ 34 of the Indian Penal Code and after investigation charge sheet submitted under section 302, 120(B) of the Indian Penal Code against the petitioner and others has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that F.I.R. was lodged against unknown and only on the basis of confessional statement petitioner has been made accused whereas Sri Jagdhar Prasad, learned Additional Public Prosecutor by way

No.40764 of 2016 (5) dt.24-10-2016 2/2 of referring to the case diary submits that during investigation it has come that in deep rooted conspiracy in the present case murder has taken place and there is sufficient material against the petitioner . He submits, by way of referring to the statement made in paragraph no. 3 of the petition, that petitioner is accused in number of cases .

Considering the fact that after investigation petitioner has already been charge sheeted as accused and the fact that he is accused in number of cases there is no reason to extend the privilege of bail.

The petition stands dismissed.
