JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in connection with Kangali P.S. Case No.13 of 2017 registered for the offence under Section 8, 20 (b) (ii) of the N.D.P.S. Act.

The allegation is with regard to recovery of 2.5 Kgs. ganja from the petitioner and one co-accused person Badri Paswan while they they were travelling on motorcycle and were apprehended by the police.

It is submitted by the learned counsel for the petitioner that the co-accused, Badri Paswan has already been granted bail by this Court vide order dated 28.06.2017 passed in Cr.Misc.No.21714/17. It is further submitted that the petitioner

Patna High Court Cr.Misc. No.30476 of 2017 (2) dt.06-07-2017 2/2 has got no criminal antecedent and he is in custody since 13.02.2017.

Having regard to the facts and circumstances of the case, I deem fit and proper to enlarge the petitioner on regular bail. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.D.J.,IIIrd, West Champaran at Bettiah, in Kangali P.S.
