JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code, sections 4(1-A) 21(D) of The Mines and Minerals (Development and Regulation ) Act, section 40(1) of Bihar Minor Mineral Concession Rules, 1972 and sections 33,41 and 42 of Indian Forest Act.

The prosecution case is that a tractor carrying stone chips was intercepted when the driver of the vehicle Anil Choudhary failed to produce any paper regarding stone chips. It is submitted by the learned counsel for the petitioner that petitioner is the son of the owner of the tractor in question. It

Patna High Court Cr.Misc. No.33655 of 2015 (2) dt.13-08-2015 2/2 is further submitted that the stone chips were being carried on valid challan.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Dehri, Rohtas in connection with Dehri (T) P.S. Case No.189 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail will be confirmed by the learned court below if on verification it is found that the petitioner is not the registered owner of the tractor in question.
