NILU AGRAWAL ORAL ORDER 22-11-2016 Heard the learned counsel for the petitioner and the learned APP for the State.

Petitioner is languishing in custody since 04.09.2016 in connection with Makhdumpur P.S.Case No.222 of 2016 registered for an offence punishable under Section 414 of the Indian Penal Code.

As per the FIR, there is allegation that the petitioner and co-accused Kishan Kumar are said to have been found in possession of stolen mobile which has been snatched from passerby and both the accused were chased and caught by the people and they were produced before the police. It has been submitted by learned counsel for the petitioner that he is an innocent and has falsely been implicated in

Patna High Court Cr.Misc. No.50122 of 2016 (2) dt.22-11-2016 2/2 the aforesaid case. It has further been submitted that the petitioner has no criminal history and nothing has been recovered from his conscious possession.

However, learned APP for the State submits that the petitioner is named in the FIR, hence opposes the prayer for bail. Considering the materials on record and the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Makhdumpur P.S.Case No.222 of 2016.
