The petitioner seeks bail in a case registered under Sections 25(1-b)a/26/35 of the Arms Act.

Prosecution case, in short, is that during patrolling duty the informant reached at Mahuwari Mor, he saw two persons riding on motorcycle coming from Mohanpur village and they were caught and on search one pistol loaded with magazine was recovered from the possession of Vishnu Kumar and a mobile was recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.03.2019 and has got no criminal antecedent. Charge sheet has been submitted in the

Patna High Court CR. MISC. No.37814 of 2019(2) dt.25-06-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. No arms is said to have been recovered from the possession of the petitioner. Same is alleged to have been recovered from co-accused. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramganj, District Rohtas in connection with Karakat P.S. case No.71 of 2019.
