In spite of indulgence granted to the respondents on 27.1.2015, no counter affidavit has been filed. The petitioner claims to have executed contract work assigned to him under agreement for the value of 1,43, 196/- . The work relates to AIR to S.D.M. residence, AIR to the office building of Assistant Jailor, AIR to S.P. residence , Buxar. Referring to Annexure-3, it has been submitted that the matter was placed before the liability committee of the department which has also found the dues admissible to the petitioner. In spite of the same the respondents have not paid the dues. Ms. Nirvikar, learned counsel for the State, on going
Patna High Court CWJC No.1370 of 2015 (3) dt.17-07-2015 2/2 through the pleadings on record fairly states that dues of the petitioner appears to be admitted and as such the respondents may be directed to pay the same in accordance with law keeping in view Annexure-3. If there is no impediment the respondents may be commanded to pay the same.
Having heard the parties, the writ application is disposed of by directing the respondents to ensure payment of the dues as admitted by the respondents in Annexure-3 as quickly as possible preferably within 06 weeks from the date of receipt/production of a copy of this order. In case the respondent(s) failed to pay/authorize the same within the time indicated above the petitioner would also be entitled to a cost in the sum of Rs. 10,000/- (Ten thousand) in addition to the amount which is due and admissible to the petitioner.
