This is a case registered under sections 399 and 402 of the Indian Penal Code and under Sections 25(1-B) A, 26 and 35 of the Arms Act.
The allegation against the petitioner is that while petitioner and other co-accused persons were digging canal for committing theft in Treasury, the police reached there and arrested all accused persons alongwith petitioner. One country made pistol has been recovered from the possession of the Petitioner. Counsel for the petitioner submits that he has falsely been implicated in this case as he had interfered in a quarrel where
Patna High Court Cr.Misc. No.33341 of 2017 (2) dt.20-07-2017 2/2 police were assaulting some persons, and for such recovery he is in custody since 11.12.2016. Though there are some cases prior to instant case has been made against the petitioner but in all cases he is on bail.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah in connection with Bettiah Town P.S.
