2. The petitioner has preferred this application for grant of regular bail in connection with S.Tr. No. 864/2024 arising out of Ramnagar P.S. Case No. 195 of 2024 dated 07.05.2024 registered for the offences punishable under Sections 302 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, on 07.05.2024 at about 01.20 PM, the neighbour Gautam dom (petitioner) along with his wife Vinaka Devi came to the house of the informant and alleged that the informant's son Sameer Dom has fled away with the daughter of Gautam Dom, and now they would take away Anchal Kumari until Puja Kumari is back home. When the
Patna High Court CR. MISC. No.39909 of 2025(2) dt.14-08-2025 2/3 informant objected then the petitioner along with 14 persons strangulated the neck of the informant's daughter and killed her.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. There is general and omnibus allegation against the petitioner. It is further submitted that there is no specific allegation against the petitioner. The petitioner has no concern with the alleged occurrence. The co-accused person has already been granted regular bail by this court vide order dated 07.05.2025 passed in Cr. Misc. No. 26107/2025. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.06.2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bagaha, West Champaran in connection with S.Tr. No. 864/2024 arising out of Ramnagar P.S. Case No. 195 of
Patna High Court CR. MISC. No.39909 of 2025(2) dt.14-08-2025 3/3 2024 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
