Petitioner is apprehending his arrest in Rajepur P.S.Case No.72 of 2018 registered for the offences under Sections 25(1-b), 26, 35 of Arms Act.

Allegation of recovery of one pistol and cartridges is from the possession of co-accused, Sumir @ Sumir Sahani. Submission of the learned counsel for the petitioner is that he has got no criminal antecedent and nothing has been recovered from his possession.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a

Patna High Court Cr.Misc. No.48328 of 2018 (3) dt.23-08-2018 2/2 period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M.,Sadar, East Champaran, Motihari, in Rajepur P.S. Case No.72 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the investigation of the case and make himself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of his bail bond.
